Program Description:
This session will explain how to properly leverage Life Insurance as an Asset Class, explore some of the hidden tax benefits, the effects from the IRS Secure Act, ownership and beneficiary arrangements, and the value of having policy reviews. In addition, the speakers will also share a few brief life insurance case examples including long-term care.

For the 2023-2024 US Supreme Court term, the Court will consider whether the proceeds of a life insurance policy taken out by a family business on a shareholder’s life for the redemption of his shares should be considered a corporate asset when calculating the value of the shares for federal estate tax purposes. The circuit split between the Estate of Connelly v. United States and Estate of Blount v. Commissioner present unique planning opportunities for attorneys, financial and wealth advisors, life insurance advisors and business owners to work collaboratively to review existing buy-sell agreements and corresponding policies, along with strategize and draft new agreements and policies, to ensure desired tax and business planning and goals are met. This roundtable will curate a discussion among advanced practitioners on these legal and practical business concerns, as well as offer some background on the respective cases and best practices and opportunities for the future.

PROGRAM OVERVIEW
Stay up to date with this informative and entertaining recap of important cases, rulings, regulations, and legislation from the past 12 months in the federal income, estate, and gift tax laws. Specific topics to be addressed will depend on the latest developments but will likely include the estate taxation of corporate-owned life insurance, gift tax consequences of modifying grantor trusts, and the latest in foreign bank account disclosure requirements.
Samuel A. Donaldson [J.D. University of Arizona; LL.M. (Taxation) University of Florida] is a Professor of Law at Georgia State University in Atlanta, where he teaches a number of tax and estate planning courses, as well as courses in the areas of property, commercial law, and professional responsibility. Prior to joining the Georgia State faculty in 2012, he was on the faculty at the University of Washington School of Law in Seattle for 13 years, where he served as the Director of the law school’s Graduate Program in Taxation as well as Associate Dean for Academic Administration. In addition to Georgia State and the University of Washington, Professor Donaldson has taught law school classes at Northwestern University, the University of Florida, and Emory University. He has won seven “professor of the year” awards from three different law schools.
He is an Academic Fellow of the American College of Trust and Estate Counsel (ACTEC) and a member of the Bar in Washington, Oregon, and Arizona. He currently serves as the Tax Editor for the Probate Practice Reporter, a monthly publication from the University of South Carolina School of Law. Among his scholarly works, Professor Donaldson is a co-author of the popular law school textbook, Federal Income Tax: A Contemporary Approach, and a co-author of the Price on Contemporary Estate Planning reference volume published by Wolters Kluwer.

TENNIS INFORMATION: This year's outing will be held at Overbrook Golf Club. Registration includes a tennis clinic and round robin tournament. Lunch is not included in the tennis registration fee. Participants are expected to wear acceptable tennis clothing on the courts. The club allows color on tennis clothing. Regulation tennis shoes are the only footwear permitted on the courts. All male players must wear collared or dri-fit shirts.

YOGA INFORMATION: Join us for a 75 minute outdoor yoga class. This class is designed to accommodate all levels and abilities. You will experience a variety of postures, expand on alignment principles and learn modifications as needed, no experience with yoga necessary. Please bring your own yoga mat. Following the class, participants will have time to use the locker rooms at the golf club prior to the cocktail reception.
