PROGRAM OVERVIEW
Existing irrevocable trusts often lack the needed flexibility to achieve certain goals. This program will explore why clients are interested in using NJSAs and other techniques to modify trusts and adjust to changing circumstances, the mechanics of using such techniques and fiduciary concerns.

Michael M. Gordon works with clients throughout the country in connection with their trust and estate planning.
Michael’s practice focuses on how clients can achieve estate planning and tax benefits through the use of Delaware trusts. Michael routinely works with clients across the country to transfer the situs of trusts to Delaware and to modify those trusts to take advantage of Delaware’s favorable trust law.
Michael’s practice is unique in that although he does work with clients locally to assist them in the construction of their estate plans he spends the majority of his time working with high net worth clients through the country, their advisors, and attorneys to assist them with Delaware-centric trust and estate planning. Michael advises his clients on complex federal wealth transfer techniques that can be accomplished through the use of Delaware trusts. Michael also assists clients throughout the country in connection with income tax planning through the use of Delaware trusts including Qualified Small Business Stock planning and state income tax planning.
Michael is recognized as one of the preeminent estate planning attorneys in the country. He is ranked by Chambers and Partners among the top attorneys in Delaware for Private Wealth Law. He is a fellow of the American College of Trust and Estate Counsel, a national organization of peer-selected lawyers and law professors who are at the top of their profession and committed to maintaining excellence in the field of trust and estate law. Michael routinely speaks at the top estate planning conferences and events throughout the country on trust and estate planning topics.

Due to a 2021 Act signed into law by President Trump that changed the IRC definition of life insurance, the effectiveness of life insurance policies utilized for income tax-free accumulation was vastly increased. As a result, one such type of policy only available to individuals who are accredited investors and qualified purchasers, private placement life insurance (PPLI), has increased in popularity for applications involving tax-efficient wealth transfer planning.
This course will examine the causes behind PPLI’s increase in use, the product’s structure and tax benefits, client suitability, statutory rules for use and the underlying investment options. A case study will detail the use of PPLI for income tax-free wealth transfer over multiple generations.
Jay C. Judas is the CEO of Life Insurance Strategies Group, an independent life insurance advisory firm,
and the co-author of the 2024 PPLI Market Report. He provides strategy, validation and structure to a wide range of individual and corporate life insurance clients globally. His firm does not sell products.
Jay is a former senior executive with Old Mutual Group where he served as member of the carrier’s extended international group executive as the Senior Vice President and Chief Distribution Officer of Global High-Net-Worth Distribution. He has held Senior Vice President roles with carriers Sun Life Financial, Crown Global Insurance Company, and BF&M Insurance Group.
Jay holds a JD from Rutgers University School of Law, a M.Sc. in Leadership from Northeastern University, and a BA in Communications from the University of Northern Iowa. He is a longtime member of Finseca and a board director of four life insurance companies in the UK Commonwealth.
